Terms of Service for MK Performing Arts - Your Agreement to Our Services
Private Lessons Agreement
1. ATTENDANCE.
We kindly remind you that enrolling for lessons indicates your commitment to them. It is anticipated that you will arrive on time and consistently. Please be advised that lessons canceled less than 24 hours in advance will not be rescheduled.
2. SCHEDULING.
We strongly encourage you to plan and book your lesson credits prior to the 15th of each month for the subsequent month, considering that time slots are in high demand and get occupied swiftly. From the 11th of the current month, teachers will start setting up schedules for the upcoming month. Depending on your tuition plan, you receive either 2 or 4 lesson credits monthly. *Please note that any extra lessons beyond your allotted credits will be billed at the rate of a single lesson.
3. PAYMENT METHODS.
Payment can be made with either Credit Card or Debit.
A valid method of payment must be kept on file in order to engage in services with Michael Karl Studio, LLC.
4. PAYMENT DUE DATE.
Monthly tuition payments will be charged automatically 10 days prior to the 1st. Any payment made after the 1st will incur a $50 late fee.
Students with a declined or outstanding tuition will be unable to take current or future lessons until their bill has been reconciled.
Drop-in Lesson or coaching payments are due at least 24 hours prior to the student’s scheduled lesson time.
5. LATE FEES.
Lesson Tuition: a $50.00 fee will be charged for any tuition payment not received before the 1st of the month.
Drop-in Lessons, and/or Coaching Sessions: In addition to the price of the lesson, a $30.00 fee will be charged automatically for any payment not received within 24-hours prior to the student’s scheduled lesson.
Outstanding payments of more than 30 days will be charged an additional $50 fee.
6. ADDITIONAL FEES.
MK Performing Arts charges a one-time $50 registration upon enrollment.
If you have taken lessons with MK Performing Arts previously and are a returning student, you will be responsible for a $25 re-entry fee.
A $30 fee will be charged for any credit card disputes.
For drop-ins and coaching sessions, additional fees may be charged for services that are not within the scope of the services agreement (e.g., providing accompaniment or printed music, etc.).
—Sheet music can be requested for $6.00.
—Piano accompaniment tracks can be made for $20.00.
7. MEDICAL DISCLAIMER.
The attention and guidance received at MK Performing Arts is not a substitution for medical care. I understand that the attention I am given is solely for technical and stylistic development as an artist.
8. LESSON TERMS.
Lessons purchased as part of your monthly tuition must be used within the month purchased and expire on the last day of the month.
9. MAKE-UP LESSONS.
We emphasize the importance of attending your scheduled lessons. If there's a need to alter the time of a planned lesson, kindly provide MK Performing Arts with a notice of at least 24 hours; failing to do so will result in your lesson credit being considered as used.
Should there be a need to reschedule your lesson beyond the 24-hour notice period, and if your teacher is unable to fulfill this request, we encourage you to get in touch with the studio before the end of the month for prompt resolution.
Please note* Any in-person lessons rescheduled after the 1st of the month will be rescheduled to online.
10. REFUNDS.
MK Performing Arts (Michael Karl Studio, LLC) will not offer a refund on any services, lesson tuition, or classes including those canceled, missed or purchased in advance. Rescheduled lessons on behalf of the student or teacher will remain at the length of time and price originally booked.
11. TERMINATION OF LESSON TUITION.
If you need to pause, cancel or terminate your lesson tuition, you may do so at anytime. Cancelation of your tuition made after the 15th of the current month will have one additional pay period and will not go into effect until the following month.
In order to cancel lessons, please go to www.mkperformingarts.com/stoplessons and submit a request. Any changes after the 15th will have one additional billing cycle before any change will go into effect.
(e.g. If a student will be terminating their tuition for the month of December, the student must inform MK Performing Arts before November 15th that they will be terminating their tuition. If no change has been made, they will be billed in-full for December tuition.)
Please note, if a student wishes to re-enroll after termination of their lesson tuition, they will be responsible for a $25 re-entry fee.
12. MODIFICATION OF LESSON TUITION.
Students are permitted to modify their lesson tuition plan as needed. To make adjustments to your plan, please visit www.mkperformingarts.com/modifylessons and follow the instructions.
Similar to termination, modifications to your tuition made after the 15th of the current month will entail one additional billing period and the changes will not be effective until the subsequent month. Any modifications made after the 15th will undergo one more billing cycle before the changes are implemented.
For instance, if a student wishes to modify their tuition plan for the month of December, they must notify MK Performing Arts via the mentioned website before November 15th about the desired changes. If no changes are submitted by this date, the student will be billed in full for December's tuition under the existing plan.
I authorize MK Performing Arts (Michael Karl Studio, LLC.) to keep my credit or debit card on file for any future transactions until I request a cancellation. I understand that any request made after the 15th of the month will require one additional payment.
I understand that by entering into lessons with MK Performing arts, I agree to terms of service and that this authorization will remain in effect until I request that they be terminated. I acknowledge that I am responsible for making this request via www.mkperformingarts.com/stoplessons
6- AND 12-MONTH DISCOUNT COMMITMENT PLAN ADDENDUM
Effective for all discounted 6- and 12-month plans (weekly or biweekly; 30/45/60 minutes).
This Addendum is part of, and incorporated into, MK Performing Arts (Michael Karl Studio, LLC.) standard service agreement (“Service Agreement”). All terms of the Service Agreement apply unless this Addendum specifically modifies them.
1) Commitment term
You are enrolling in a 6-month or 12-month commitment plan at a discounted rate. The commitment begins on your plan start date confirmed by the studio.
2) Grace period to use lessons
To account for travel, illness, scheduling conflicts, or other interruptions, your plan includes a built-in grace period:
6-month plan: lessons must be used within 7 months from the plan start date
12-month plan: lessons must be used within 14 months from the plan start date
Unused lessons/credits after the grace period expire and have no cash value.
3) Lesson scheduling + credits
Lessons are scheduled in a recurring time slot.
You are responsible for maintaining your scheduled time and communicating changes in advance.
Depending on your plan (weekly or biweekly), you will receive the corresponding lesson credits.
Any lessons taken beyond your plan’s included credits may be billed at the single-lesson rate.
4) Attendance and cancellations
Enrolling in lessons indicates your commitment to consistent attendance and punctuality.
Lessons cancelled with less than 24 hours notice are not eligible to be rescheduled and the credit is considered used.
If you need to adjust a lesson time, provide at least 24 hours notice. If your teacher cannot accommodate a change, contact the studio before the end of the month (or within the plan’s grace period if you are making up time).
5) Rescheduling and monthly scheduling window
If you know you’ll be unavailable, MKPA strongly encourages you to reschedule before the 15th of the prior month for the upcoming month.
From approximately the 11th of the current month, teachers begin building schedules for the upcoming month.
6) Payment method requirements (UPDATED per your note)
All discounted 6- and 12-month plans must be paid via ACH / bank transfer.
Monthly discounted plans (6 or 12 months):
Require ACH / bank transfer
Require one active credit card on file as backup payment method
Require a refundable deposit:
6 months: $49 refundable deposit
12 months: $99 refundable deposit
Paid-in-full discounted plans (6 or 12 months):
Must be paid via ACH / bank transfer
No deposit required
No credit card is required on file if paid in full
If required payment methods are not maintained, MKPA may pause lessons and/or the discounted rate until the account is compliant.
7) Payment timing, late fees, and outstanding balances
Monthly tuition payments are charged automatically 10 days prior to the 1st.
Any payment made after the 1st may incur a $50 late fee.
Students with a declined or outstanding balance may be unable to take current or future lessons until the bill is reconciled.
Outstanding payments beyond 30 days may incur additional fees consistent with the Service Agreement.
8) Fees that still apply
Unless MKPA confirms otherwise in writing, the following still apply:
One-time $50 registration fee upon enrollment
$25 re-entry fee for students re-enrolling after termination
Additional service fees (sheet music, accompaniment tracks, etc.) where applicable
9) No refunds for commitment plans
Because these plans include a discounted rate and reserved scheduling, all plan payments are non-refundable once processed, including but not limited to:
stopping lessons early
schedule conflicts
missed lessons
travel or relocation
illness or inability to attend
coach changes
If you cannot use your plan, your remedy is to:
use lessons within the grace period, and/or
transfer the plan as described below
10) Billing disputes and chargebacks
You agree to contact MKPA first to resolve billing concerns.
For discounted commitment plans, you agree not to dispute or charge back plan charges through your bank/payment provider. If a dispute/chargeback occurs, MKPA may:
pause lessons/credits until resolved
require additional verification or alternate payment arrangements
charge any fees MKPA incurs from the dispute process (where permitted)
11) Teacher assignment is not guaranteed
You are not entitled to a specific teacher. MKPA reserves the right to move you to a different teacher at any time if:
your teacher becomes unavailable, or
scheduling and staffing requires a change
MKPA will make a reasonable effort to place you with an appropriate coach based on goals and availability.
12) Make-up lessons and online reschedule rule
Missed lessons without proper notice are considered used.
Any makeups are scheduled subject to availability and must occur within the plan’s grace period.
Any in-person lessons rescheduled after the 1st of the month will be rescheduled to online (consistent with your current policy).
13) Lesson expiration rule is modified for commitment plans
Your standard Service Agreement states monthly tuition credits expire at month-end. For these commitment plans, credits are governed by the plan grace period (7 months for 6-month plans; 14 months for 12-month plans). After the grace period, unused credits expire.
14) Transfer and re-gift policy
If you are unable to use your remaining plan credits, you may transfer (“re-gift”) the plan under these rules:
Transfer must be requested in writing (email is acceptable)
Credits may be transferred to one recipient unless MKPA approves otherwise
Credits must be used within the original plan grace period (the clock does not reset)
Credits have no cash value and may not be sold
15) Medical disclaimer, liability, and participation risk
All medical disclaimer and liability provisions in the Service Agreement continue to apply to commitment plans.
16) What happens when the plan ends: month-to-month continuation
Once your commitment plan credits are fully used (or the grace period ends), your lessons will continue month-to-month under MKPA’s standard tuition structure unless you provide notice.
To pause, cancel, or terminate ongoing month-to-month tuition, you must submit a request using MKPA’s official process. Requests made after the 15th of the month will have one additional billing cycle and take effect the following month, consistent with your Service Agreement termination policy.
17) Acknowledgment
By enrolling, you acknowledge you understand:
This is a discounted 6- or 12-month commitment plan with a defined use window (grace period)
Payments are non-refundable once processed
Payment must be made via ACH/bank transfer; monthly plans also require a backup credit card on file
Coach assignment may change
Lessons continue month-to-month after plan use unless proper notice is given
Group Class Agreement
PAYMENT: Payment for group classes can be made in full at the time of registration or through a payment plan. For payment plans, a non-refundable deposit is required to secure your spot in the class, with the remaining balance to be paid in installments according to the agreed-upon schedule. If a student is on a payment plan, they cannot have any outstanding payments and must pay any outstanding balance for the class. Payment can be made via credit card, debit card, or other payment methods accepted by MK Performing Arts. Students who have outstanding balances will not be allowed to attend class until the balance is rectified.
REFUNDS: Classes purchased in advance cannot be refunded. In the event that the studio cancels a class, a full refund will be issued.
ATTENDANCE: Prompt and regular attendance is expected of all students. Students who miss more than two classes may be asked to leave the class and forfeit their reserved spot. If a student misses a class, they may not receive a make-up class or credit for future classes.
LIABILITY WAIVER: By registering for a group class, students acknowledge and agree that they participate at their own risk. MK Performing Arts is not responsible for any injuries sustained during class or any personal belongings lost or stolen on the premises. Students are responsible for informing the teacher of any physical limitations or injuries they have prior to the start of class.
CLASS CANCELLATIONS: MK Performing Arts reserves the right to cancel a class due to low enrollment, teacher illness, or other unforeseen circumstances. In the event of a cancellation, students will be offered a make-up class or a credit for future classes.
CLASS DESCRIPTIONS: MK Performing Arts makes every effort to accurately describe each class offered. However, class content and schedule may be subject to change at the discretion of the teacher.
AGE REQUIREMENTS: Group classes are open to students of all ages. Some classes may have specific age requirements or restrictions. Students are responsible for checking age requirements prior to registration.
BEHAVIOR: MK Performing Arts expects all students to behave in a respectful and appropriate manner during class. Disruptive or inappropriate behavior will not be tolerated and may result in removal from the class.
PAYMENT INCENTIVES: To incentivize timely payment, MK Performing Arts reserves the right to require a debit or credit card to be kept on file for all payment plans. If a student fails to make payments on time, the studio reserves the right to pursue collections. Students who make timely payments will receive priority enrollment in future classes.
University Prep Agreement
DESCRIPTION OF SERVICES: The University Prep Program is a package of services that includes audition coaching, dance coaching, voice coaching, and acting coaching. The package is designed to provide students with the tools and skills necessary to succeed in the university application and audition process. While MK Performing Arts will provide guidance and support to students, it cannot guarantee acceptance into any specific school or program. However, the studio will work with students to ensure they have the necessary skills and resources to succeed in their auditions.
APPOINTMENTS: All appointments must be scheduled at least 48 hours in advance. If you need to cancel or reschedule an appointment, you must provide at least 48 hours' notice. Additional hours that are missed or canceled without sufficient notice will be billed at $100/hour. If an appointment requires multiple coaches, you may be charged for each individual service at a separate rate.
AUDITION COACHING: For all audition coaching sessions, students must be completely memorized and off book. All material, including dance routines, must be learned and practiced prior to the appointment. Students who are not memorized will be sent home and the coaching will be forfeited.
REFUNDS: There are no refunds for any reason.
SERVICES: The University Prep Program is a package of services that includes audition coaching, dance coaching, voice coaching, and acting coaching. The package is designed to provide students with the tools and skills necessary to succeed in the university application and audition process.
PAYMENT: Payment for the University Prep Program must be made in full at the time of registration. Payment can be made via credit card, debit card, or other payment methods accepted by MK Performing Arts.
VOICE LESSONS: Musical Theatre Students are required to be in weekly on-going voice lessons throughout the entirety of the year. While students are not required to use MK Performing Arts for their private voice lessons, they must attend weekly voice lessons with a private voice teacher.
LIABILITY WAIVER: By enrolling in the University Prep Program, you acknowledge and agree that you participate at your own risk. Michael Karl Studio, LLC. (MK Performing Arts) is not responsible for any injuries sustained during coaching sessions or any personal belongings lost or stolen on the premises.
BEHAVIOR: MK Performing Arts expects all students to behave in a respectful and appropriate manner during coaching sessions. Disruptive or inappropriate behavior will not be tolerated and may result in removal from the program.
By enrolling in the University Prep Program, you acknowledge that you have read and understand these terms of service and agree to be bound by them.
By using our services, you acknowledge and agree that you are bound by our policies, including our Terms of Service, Privacy Policy, and any other policies or guidelines that we may publish from time to time. You understand and agree that you are responsible for reviewing and complying with these policies, even if you have not signed a separate agreement acknowledging them.
Your use of our services constitutes your acceptance of these policies and any updates or changes to them. If you do not agree to these policies, you must immediately stop using our services.
