Terms of Service

These Terms apply when you use the MK Performing Arts website or platform, and alongside the enrollment agreement you sign when a student takes lessons, classes, camps, or coaching with us.

Who You Are Contracting With

MK Performing Arts is the trading name of Michael Karl Studio, LLC d/b/a MK Performing Arts, a Georgia limited liability company at 1640 Roswell Street Southeast, Suite G, Smyrna, GA 30080. In these Terms, "MKPA," "we," and "us" mean that company.

Which Document Governs What

These Terms cover using the website and platform. They are not the whole agreement for lessons.

  • Lessons, tuition, scheduling, missed lessons, late fees, refunds, and stopping or changing a plan are governed by the Private Lesson Policy Agreement that the account manager signs before or at enrollment. Where these Terms and a signed enrollment agreement differ, the signed agreement controls.
  • Classes, camps, and programs may have their own registration form, waiver, and dates disclosed before purchase.
  • Using the platform itself — accounts, permitted use, and security — is covered by the End-User License Agreement.
  • How we handle information is covered by the Privacy Policy.

Who May Enroll, and Who Signs for a Minor

If the student is under 18, a parent or legal guardian must complete the enrollment, holds the billing relationship, and accepts the applicable terms on the student's behalf. By enrolling a student, you confirm that you are that student's parent or legal guardian, or that you otherwise have legal authority to enroll them.

A student must be at least 13 years old to hold their own sign-in to the platform. For a student under 13, the parent or guardian uses the account.

You agree to keep contact, emergency, and payment information current, and to tell us about any condition or restriction that is reasonably necessary for the student to take part safely.

Lessons, Scheduling, and Instructors

Lesson times, class schedules, instructor assignments, program dates, and locations are subject to availability. We may reasonably substitute an instructor, reschedule a lesson, move an in-person lesson online, or adjust a program schedule when necessary — for example for illness, weather, or a venue change.

Where a lesson is rescheduled — whether at the student's request or ours — it keeps the length and price originally booked. How rescheduling, missed lessons, and make-ups work is set out in the Refunds & Cancellations policy.

Tuition and Recurring Billing

Monthly tuition plans renew automatically each billing period until they are stopped. Before we take a recurring payment authorization we will disclose the amount, the billing frequency, and how to stop the plan. You authorize us to keep a payment method on file and to charge it for tuition and other agreed charges until you stop the plan.

You can stop or change a plan yourself from the client portal, or by submitting a Notice of Cancellation. Timing, deadlines, late fees, and refund treatment are set out in the Refunds & Cancellations policy and in the signed enrollment agreement.

No Guaranteed Results

Coaching and instruction are educational services. MKPA does not guarantee auditions, callbacks, roles, admission to any school or program, scholarships, representation, employment, or any other outcome. Testimonials and results described in our marketing are the real experiences of particular students and are not a promise of what any other student will achieve.

Recording, Photographs, and Video

Ordinary lessons are not recorded. Consultations are recorded, and you are told before you join and must confirm the recording notice in order to take part. Where any other session would be recorded, we will obtain consent from every participant first, and a parent or guardian's authorization for a minor.

Permission to use photographs or video of a student for our website, social media, or promotional material is separate and always optional. Declining it never affects a student's lessons or place in a program.

Your Content and Uploads

You keep ownership of the material you upload — audition videos, recordings, documents, and notes. You give MKPA permission to store, display, and process that material only as needed to provide the service to you and your student, including for your coach to review it and give feedback.

You must have the right to upload what you upload. Our Copyright Policy explains what is not permitted and how a rights holder can report material they believe infringes their rights.

Acceptable Use

  • Use the website and platform only for your own lessons, programs, and account, and only in the role assigned to you.
  • Do not attempt to reach information outside your role, share account access, scrape data, interfere with the service, or use it for an unlawful purpose.
  • Treat staff, students, and families with respect in every message sent through the platform.
  • We may suspend or end access to the platform where an account is misused, creates a security risk, or breaches these Terms.

Disclaimers and Limits

The website and platform are provided as available and may change over time. We do not guarantee uninterrupted or error-free operation.

Instruction is not medical, therapeutic, or psychological care. Guidance given at MKPA is for artistic and technical development and is not a substitute for professional medical advice.

To the fullest extent permitted by law, MKPA is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or platform. Nothing in these Terms limits or excludes any liability or consumer right that applicable law does not permit us to limit or exclude.

Governing Law and Changes

These Terms are governed by the law of the State of Georgia, without limiting any consumer protection that cannot lawfully be waived.

We may update these Terms from time to time. The updated date at the top of this page shows the latest revision. If a change materially affects an active enrollment, we will give notice before it takes effect.
